ABSTRACTIn the past millennium, there have been thousands of polities in Europe and millions of laws. This article contributes to efforts by historians and sociologists to make some sense of this sprawl by constructing common types of law and legal change. Such types constitute distinctive patterns by which historical actors change names, ideas, and applications of rules of law under various circumstances. Three classic forms of change, namely legislation, mutation of custom, and judge‐made law, were described by Max Weber. To (...) Weber's model I add four new types or motifs of change, which I dub legal deeds, voice‐supersession, legal fictions, and anthropological expansion. The major advance of the four motifs is that they each combine what could be called a semantic and a social view of legal change. That is, they take seriously the fact that law is often bound in a self‐conscious tradition of thought and practice. But each motif of change is also characterized by a typified social configuration of legal operators and legal subjects, who apply competing ideas to one another in distinctive ways. The paradigm of law in which the four motifs are embedded is evolutionary, pluralist, and liberal in that it posits creative social organization by multiple, independent, interacting individuals in society, weaving cumulative, complex orders.This theory makes several significant scholarly interventions. First, it attempts to reconcile outstanding semantic and social theories of legal change. Second, it historicizes legal pluralism while giving evolutionary theory a healthy dose of contingency. Third, the four motifs should also be serviceable to intellectual historians as tools for describing how historical actors interact with traditions generally. Tradition need not be viewed as conservative or even overwhelmingly static. This paradigm may help historians and social scientists assess how the force of the status quo balances against the power of individuals to innovate. (shrink)

Many weaknesses of game theory are cured by new models that embody simple cognitive principles, while maintaining the formalism and generality that makes game theory useful. Social preference models can generate team reasoning by combining reciprocation and correlated equilibrium. Models of limited iterated thinking explain data better than equilibrium models do; and they self-repair problems of implausibility and multiplicity of equilibria.

Background There is lack of consensus in the bioethics literature regarding the use of cardiopulmonary resuscitation (CPR) for organ-preserving purposes. In this study, we assessed the perspectives of clinicians in critical care settings to better inform donor management policy and practice.Methods An online anonymous survey of members of the Society of Critical Care Medicine that presented various scenarios about CPR for organ preservation.Results The email was sent to 10,340 members. It was opened by 5,416 (52%) of members and 405 members (...) (4%) completed the survey with few missing data. A majority of respondents (81%) answered that donation status should not influence whether CPR is performed on an imminently dying patient. There was very strong agreement (>85%) that 1) CPR should be performed on a registered donor who experiences a cardiac arrest with an unknown code status before death by neurological criteria (DNC) and 2) CPR should be performed if the patient is not a registered donor and experiences cardiac arrest but the surrogate/power of attorney (POA) has not yet been approached regarding code status and donation. When a registered donor with a DNR order experiences cardiac arrest before DNC, 98% of respondents would not perform CPR. However, after DNC, respondents were evenly divided on whether they would (49%) or would not (51%) perform CPR on a registered donor with an undocumented code status. When asked whether consent should be required for CPR for organ-preserving purposes, 39% answered “Yes” when a patient arrests before DNC and 48% answered “Yes” when a patient arrests after DNC (P = 0.2).Conclusions The majority of respondents did not consider donor status relevant to CPR decisions before DNC, and virtually all would respect a DNR order in a registered donor before DNC. Respondents were divided about the need for an affirmative consent for CPR for organ-preserving purposes both before and after DNC. (shrink)

On intellectual foundations that distinguished chemical engineering from other disciplines.

The emergence in Britain of chemical engineering, by mid‐century the fourth largest engineering specialism, was a hesitant and drawn out process. This article analyses the organisational politics behind the recognition of the technical occupation and profession from the First World War through to the end of the 1920s. The collective sense of professional identity among nascent ‘chemical engineers’ developed rapidly during this time owing to associations which promoted their cause among potential patrons. -/- .

Chemical engineering - as a recognised skill in the workplace, as an academic discipline, and as an acknowledged profession - is scarcely a century old. Yet from a contested existence before the First World War, chemical engineering had become one of the 'big four' engineering professions in Britain, and a major contributor to Western economies, by the end of the twentieth century. The subject had distinct national trajectories. In Britain - too long seen as shaped by American experiences - the (...) emergence of recognised chemical engineers was the result of professional aspirations and contingency, and shaped by a shifting ecology of institutions, firms and government. Drawing upon extensive archival research, this book examines the evolution of technical practice, working environment and social interactions of chemical engineering. Duquesne University has already given us a number of works on the philosophy of nature, which is one of the most difficult and important parts of philosophy. Those of Van Melsen and Van Laer in particular will be recalled. The author of the present work, Fr. Koren, who became editor of Duquesne Studies in 1952, has already published a textbook on Metaphysics, reviewed in Vol. VII of Philosophical Studies, and another on the Philosophy of Man. The U.S. stock market is one of the largest and most complex marketplaces in the global financial system. Over the past several decades, this market has evolved at multiple structural and temporal scales. New exchanges became active, and others stopped trading, regulations have been introduced and adapted, and technological innovations have pushed the pace of trading activity to blistering speeds. These developments have supported the growth of a rich machine-trading ecology that leads to qualitative differences in trading behavior at human (...) and machine time scales. We conduct a longitudinal analysis of comprehensive market data to quantify nonstationary dynamics throughout this system. We quantify the relationship between fluctuations in the number of active trading venues and realized opportunity costs experienced by market participants. We find that information asymmetries, in the form of quote dislocations, predict market-wide volatility indicators. Lastly, we uncover multiple micro-to-macro level pathways, including those exhibiting evidence of self-organized criticality. (shrink)

The development of a professional identity is particularly interesting for those occupations that have a troubled emergence. The hinterland between science and technology accommodates many such ‘in-between’ subjects, which appear to have distinct attributes. Some of these specialisms disappear in the face of culturally stronger occupations. Others endure, their technical expertise becoming appropriated or mutated to serve the needs of different professional groups. This chapter is concerned with one extreme of these interstitial specialisms. Chemical engineering – a subject that by (...) its very name is between the science of chemistry and the technology of engineering – did eventually become a profession, in at least some countries. It had a relatively easy time becoming established in America in the first third of this century, but chemical engineering remained largely unrecognised in Germany until the 1960s, and has attracted a smaller professional community there. In Britain, the chemical engineering profession has evinced distinct transitions over a period of a century. It emerged to become an influential contributor to western economies and one of the ‘big four’ engineering professions (along with civil, mechanical and electrical engineering) after the second world war, due in large part to the unmindful aid of an influential, if capricious, sponsor: the state. Yet chemical engineers had a long and troubled history of contestation with other professions. Because of this, the British case is particularly appropriate for examining the continual re-casting of the professional identity in response to external and internal pressures. (shrink)

ObjectivesTo investigate the external and ecological validity of a standardized test of children’s executive functioning, the Behavioral Assessment of the Dysexecutive Syndrome for Children.BackgroundThere are few standardized measures for assessing executive functions in children, and the evidence for the validity of most measures is currently limited.MethodA normative sample of 256 children and adolescents from age 8–16 years completed the BADS-C, and a parent or teacher completed rating scales of the child’s everyday problems related to EF and Strengths and Difficulties Questionnaire, (...) a commonly used measure of emotional, social, cognitive, and behavioral problems.ResultsExploratory factor analyses yielded a two-factor structure to the BADS-C, indicative of monitoring and abstract reasoning processes, and a three-factor structure to the DEX-C, reflecting behavioral, and cognitive components of the dysexecutive syndrome as well as emotional responsiveness. Regression analyses showed significant relationships between BADS-C scores and everyday functioning as reported on the DEX and SDQ. Furthermore, there were significant differences in BADS-C scores between those children in the upper and lower quartiles on the SDQ.ConclusionResults provide tentative evidence of BADS-C and DEX-C construct, convergent and predictive validity. We investigated the impact of attention during encoding on later retrieval. During study, participants read some words aloud and named the print color of other words aloud . Then one of two memory tests was administered. The explicit test—recognition—required conscious recollection of whether a word was studied. Previously read words were recognized more accurately than were previously color named words. This contrasted sharply with performance on the implicit test—repetition priming in lexical decision. Here, words that were color named during study (...) showed priming equivalent to words that were read during study; both were responded to faster than unstudied words. Thus, an attentional manipulation during study had a strong effect on an explicit test of memory, but almost no effect on an implicit test. Focal attention during study is crucial for remembering consciously but not necessarily for remembering without awareness. (shrink)

Cramer et al. articulate a novel perspective on comorbidity. However, their network models must be compared with more parsimonious latent variable models before conclusions can be drawn about network models as plausible accounts of comorbidity. Latent variable models have proven generative in studying psychopathology and its external correlates, and we doubt network models will prove as useful for psychopathology research.

Recreational Drugs European Network (ReDNet) project aims to use the Psychonaut Web Mapping Project database (Psychonaut Web Mapping Group, 2009) containing novel psychoactive compounds usually not mentioned in the scientific literature and thus unknown to clinicians as a unique source of information. The database will be used to develop an integrated ICT prevention approach targeted at vulnerable individuals and focused on novel synthetic and herbal compounds and combinations. Particular care will be taken in keeping the health professionals working directly with (...) young people showing problematic behaviors regularly updated in terms of novel compounds and combinations as well. A user-friendly project website will be developed aimed primarily at delivering the information/prevention approaches, but will also be a way of communicating with project partners and relevant stakeholders (e.g. thematic forum facilities, instant messages, blogs, video chat, wikiblog, newsletters distributed via mailing list). This article argues that, despite its reputation as a homogenising and authoritarian system, the political thought of Bernard Bosanquet contains resources with which to develop a robust and culturally sensitive model of liberal multiculturalism. Throughout the discussion, Bosanquet's thought is located within contemporary theoretical debates. The first section rehearses the critique of Millian liberalism developed by Bhikhu Parekh and others, which alleges that the considerations of individuality and autonomy underlying such a political order preclude it from showing adequate respect for (...) cultures which do not conceive of personal identity in essentially individualistic terms. The next section sketches Bosanquet's social theory, as a preclude to the rebuttal of allegedly insurmountable barriers to the theory's accommodation of cultural diversity. Specifically, section three counters the objection that Bosanquet sanctions the imposition of internal restrictions on personal dissent. The final section rebuts the claim that a General Will cannot exist within a culturally diverse society, showing that in reality Bosanquet's theory leads us to endorse the ‘fundamental beliefs’ of a multi-ethnic society outlined recently in the Parekh Report. It is concluded that, when drawing on Bosanquet's thought, a liberal multicultural society can take different forms and yet still show proper respect for cultural diversity. (shrink)

In this chapter, I argue that Kant can be read as holding that "ought" judgments follow from certain "is" judgments by mere analysis. More specifically, I defend an interpretation according to which (1) Kant holds that “S ought to F” is analytically equivalent to “If, as it can and would were there no other influences on the will, S’s faculty of reason determined S’s willing, S would F” and (2) Kant’s notions of reason, the will, and freedom are all fundamentally (...) non-normative. Not only does this reading have significant textual support, but, I claim, it also sheds light on why Kant takes freedom and morality to mutually imply one another. Moreover, while Kant does take there to be a gap between moral judgments and empirical descriptive statements, that gap is consistent with the analysis in question. I conclude by arguing that this rejection of the is-ought gap is not as philosophically implausible as it might seem, with a focus on G.E. Moore and Hume’s arguments for certain ‘gaps’ between the normative and the non-normative. (shrink)

In every intellectual tradition for which internal debate is central, the substance of the constitutive contestations sometimes concerns the aims and achievements of the tradition itself. In the case of pragmatism, the long history of these contesting interpretations is well known. Recent pragmatist philosophy has been characterized by debates between analytic neo-pragmatisms and so-called ‘American’ classico-pragmatisms. Along with utilitarianism, British idealism was the most important philosophical and practical movement in Britain and its Empire during the late-nineteenth and early-twentieth centuries. Even though the British idealists have regained some of their standing in the history of philosophy, their own historical theories still fail to receive the deserved scholarly attention. This article helps to fill that major gap in the literature. Understanding historiography as concerning the appropriate modes of enquiring into the recorded past, this article analyses the key (...) historiographical commitments that underpin the writings of the early T.H. Green (section two), Edward Caird (section three), and F.H. Bradley (sections four and five). Section six explores the influence of Bradley's historiography. These approaches are linked by the belief that all thought can be properly understood only by critical historians who possess the appropriate tools with which to distinguish permanently valid truths from the transient imperfections with which those truths are mixed. A crucial division between them is the invocation of a neo-Hegelian Geist by the early Green and Caird, and Bradley's reliance on a progressive human nature. Moreover, the article establishes that R.G. Collingwood's highly influential theories of “absolute presuppositions” and “re-enactment” were taken largely from Bradley's historiography. (shrink)

This article proposes an essential interrelatedness of Vermeer’s strategies of inclusion and exclusion of an implied beholder. I will argue that such strategies mutually reinforce each other, to the extent that the plausibility of one is arguably dependent upon the possibility of the other. This is evidenced by Vermeer’s subtle manipulations of pictorial space, and the article traces a decisive shift in his familiar use of barriers from those aimed at an external presence to those oriented towards an internal beholder. The feasibility of this interdependence rests upon a theory of imaginative engagement with paintings that can accommodate both an internal beholder and the felt lack of occupancy of the imagined situation’s point of view. I argue that the Dependency Thesis, as set out by M. G. F. Martin, can provide plausibility for both kinds of imaginative engagement with paintings, when sensory imagination is conceived as an instance of imagining seeing. These engagements exploit the notorious emptiness of imagination’s necessarily perspectival point of view. (shrink)

Traditionally, there has been a clear distinction between classical systems and quantum systems, particularly in the mathematical theories used to describe them. In our recent work on macroscopic quantum systems, this distinction has become blurred, making a unified mathematical formulation desirable, so as to show up both the similarities and the fundamental differences between quantum and classical systems. This paper serves this purpose, with explicit formulations and a number of examples in the form of superconducting circuit systems. We introduce three (...) classes of physical systems with finite degrees of freedom: classical, standard quantum, and mixed quantum, and present a unified Hilbert space treatment of all three types of system. We consider the classical/quantum divide and the relationship between standard quantum and mixed quantum systems, illustrating the latter with a derivation of a superselection rule in superconducting systems. ABSTRACTThis article surveys and contextualizes the British idealists’ philosophical writings on language, aesthetics and emotions, starting with T. H. Green and concluding with Michael Oakeshott. It highlights ways in which their philosophical insights have been wrongly overlooked by later writers. It explores R. L. Nettleship’s posthumous publications in this field and notes that they exerted significant influences on British idealists and closely related figures, such as Bernard Bosanquet and R. G. Collingwood. The writing of other figures are also explored, not (...) least F. H. Bradley and J. A. Smith. The article concludes by introducing in turn the remaining articles that are found in this special issue. (shrink)

M z ,f any have suggested that the findings of social choice theory demonstrate that there can be no "will of the people." This has subversive implications for our intuitive concept of self-government. I explore the relation between the notion of a "social will," that of self-government, and the impossibility theorems of social choice theory. I conclude that although the concept of the social will is essential to that of self-government, the findings of social choice theory do not cast doubt (...) upon the possibility of either. Unlike many attempts to respond to the threat posed by social choice theory, my argument does not require any appeal to the problematic notion of the common good. (shrink)

We are used to seeing foundations linked to the mainstream mathematics of the late nineteenth century: the arithmetization of analysis, non-Euclidean geometry, and the rise of abstract structures in algebra. And a growing number of case studies bring a more philosophy-of-science viewpoint to the latest mathematics, as in [Carter, 2005; Corfield, 2006; Krieger, 2003; Leng, 2002]. Mac Lane's autobiography is a valuable bridge between these, recounting his experience of how the mid- and late-twentieth-century mainstream grew especially through Hilbert's school.An autobiography (...) at age 94 obviously has a lot of ground to cover. Mac Lane entered Yale in 1926 to study chemistry as a good practical career field but by the end of his first year he had won a $50 prize in mathematics and learned that you could make a living with it—as an actuary. He decided to do that. The next year he was excited to learn from his philosophy professor F.S.C. Northrop that you can also pursue new mathematical discoveries! Northrop had studied with A.N. Whitehead and sold Mac Lane on the excitement of Principia Mathematica. In a pattern that foreshadowed his career Mac Lane bought and annotated a copy of the first volume of Principia but his planned tutorial study of the book turned into a study of [Hausdorff, 1914] applying set theory to topology and analysis. As a graduate student at Chicago he was powerfully influenced by E.H. Moore, who taught the new axiomatic methods as tools for unifying and advancing the most classical analysis . Then he went to Göttingen. He heard Hilbert lecture on philosophy. He studied mathematics and its philosophy with Weyl. He followed Noether's lectures on abstract algebra for number theory.
